IV. [§ 3.4] FALSE IMPRISONMENT

On May 25, 2021, John Smith took his 10-speed bicycle to the "Coast to Coast" Bicycle Shop in Baltimore County, Maryland, to have the gear assembly repaired. George Harris, the shop's owner, informed Smith that the cost of this repair would be $175. Smith wrote Harris a check for $175 and was told that his bicycle would be ready in a few days.

On June 2, 2021, Smith returned to pick up his bicycle. Seeing Harris in the back of the shop where the repair work is done, Smith walked into the back to retrieve his bicycle. As Harris was pulling Smith's bicycle down from the rack, he informed Smith that the cost of the repair would be $175 and explained that the repairs cost $100 more than anticipated, because the damage to the gears was more severe than he had believed when he first looked at the bicycle.

Smith became angry, reminded Harris that he had paid the estimate of $175 in full, and said that he had no intention of paying anything more than that. Harris then locked the back room of the shop and told Smith he could not leave until he paid the additional money. Harris kept Smith locked in the back room for 15 minutes, finally allowing him to leave, without his bicycle, when Smith continued to bang on the door and shout for help. Smith sued Harris for false imprisonment.

John Smith (hereinafter "Smith"), Plaintiff, by his attorneys, Adrian P. Jansen and Jansen & Jansen, P.A., sues George Harris (hereinafter "Harris"), Defendant, and states:
1. Plaintiff Smith is a resident of Baltimore County, Maryland.
2. Defendant Harris is a resident of Baltimore County, Maryland, and at all times relevant hereto was the proprietor of the Coast to Coast Bicycle Shop located in Baltimore County, Maryland.
