I. INTRODUCTION

The primary purpose of discovery is to learn new facts about the case: these facts may be good or bad for your side or they may be absent. The discovery rules are liberally construed to permit disclosure of facts. However, strict compliance with the Rules is necessary. In discovery, each side learns what the opponent's evidence and theory are with respect to the claim or defense. Discovery not only permits a party to obtain evidence, but to preserve it through deposition testimony and documents. Discovery permits parties to obtain leads for further discovery which may result in additional evidence, permits parties to pin down the opponent's witnesses and enables the parties to prepare for trial.
