§9.1 INTRODUCTION
This chapter surveys five professional responsibility issues commonly encountered by civil litigators: (1) the rules governing the handling of an opponent's inadvertently produced privileged or otherwise confidential documents; (2) the lawyer-witness rule; (3) the "no contact" rule; (4) discovery ethics within the context of RPC 3.4; and (5) the parameters of conducting investigations through electronic social media and other public internet sources.
