Intermunicipal Agreement for Use of Fuel Storage Facilities

THIS AGREEMENT, made the ___ day of __________, 20___ by and between the __________ Fire District (hereinafter referred to as “District”) and the Town of __________, New York (hereinafter referred to as “Town”).

WHEREAS, the TOWN owns and operates fuel storage facilities necessary to operate it fleet of vehicles; and

WHEREAS, such facilities have surplus capacity; and

WHEREAS, the FIRE DISTRICT is desirous of gaining access to and the right to purchase such fuel from the TOWN; and

WHEREAS, the Town is authorized to execute this agreement by a resolution, adopted by the __________ Town Board on the ___ day of __________, 20___, a copy of said Resolution is attached as Exhibit “A”; and

WHEREAS, the Fire District is authorized to execute this agreement by a resolution, adopted by the __________ Board of Fire Commissioners on the ___ day of __________, 20___, a copy of said Resolution is attached as Exhibit “B”; and

NOW, THEREFORE, IT IS AGREED AS FOLLOWS:

1. To be effective, the governing board of the parties must approve participation before execution of this Agreement shall be effective.

   The TOWN shall make available to the FIRE DISTRICT fuel for its vehicles under the following terms and conditions:
