Congress ends forced arbitration for sexual harassment claims

With strong bipartisan support, Congress approved a #Me-Too inspired bill that essentially gives employees the choice of going to court or going to arbitration to resolve sexual harassment claims. It forbids employers from requiring arbitration in such cases. President Biden says he will sign the bill. The law is retroactive, meaning it invalidates any such required arbitration clauses in ongoing cases.

Advice: If you have any mandatory arbitration agreements on file, check with your attorney to see if they specifically require arbitration of sexual harassment claims. If so, they may need to be revised based on the law.
