The Ninth Circuit Court of Appeals recently agreed with Idaho that the U.S. Department of Energy must remove all transuranic waste (rags and other debris contaminated with radioactive elements heavier than uranium) from the Idaho National Laboratory. This waste resulted from Cold War nuclear weapons production. Some of the transuranic waste was buried underground in unlined pits 600 feet above the Snake River aquifer.
