I. Prejudgment Interest
Unlike South Carolina common law causes of action, which rarely will yield recovery of prejudgment interest in tort cases, prejudgment interest (at the legal rate) is available in suits under section 35-1-509 of the South Carolina Code. Prejudgment interest is also available in suits brought under sections 12 and 15 of the 1933 Act.110
