I. [§ 6.1] POSSESSION OF PROPERTY

John Smith purchased a home and 13 acres of land in Baltimore County from John Pineau in September 1990. Pineau also owned 50 acres of land adjacent to the property he sold to Smith. These 50 acres of land contained a small meadow and stream, which abutted Smith's property.

Smith, in October 1990, ran a new fence line onto the meadow to the other side of the stream to enable his animals to have access to the pasture and stream. Smith maintained the fence line and pasture area, including the stream bed, for 25 years.

In October 2022, Pineau sold his 50 acres of land to George Harris. In November 2022, Harris dismantled Smith's fence, cut down all trees in the meadow and, over Smith's objection, constructed a run-in shed for Harris's animals. Smith instituted suit against Harris for possession of property.
