I. [§ 11.1] STATE ANTITRUST ACTIONS

John Smith Company is in the construction business. It purchases large amounts of concrete for use in its construction projects. There are three concrete manufacturers in Smith's area from which it can and does buy concrete. George Harris Company is one of those companies.

John Smith Company noticed that the price of concrete, quoted by all three companies, seemed to be increasing at an alarming rate. After a period of time, a disaffected former employee of George Harris Company contacted an officer of John Smith Company and advised him that all three concrete companies had conspired to fix the prices of their concrete. After further investigation and separate discussions with all three concrete companies, John Smith Company settled with two of the companies without filing suit. Negotiations with George Harris Company broke down and John Smith Company filed suit for price fixing under the Maryland Antitrust Act.
