H. Death by Lynching

If a victim dies as a result of a lynching, the county where the death ensues is liable for punitive damages of not less than two thousand dollars.30 In order to recover against the county for lynching, the plaintiff must prove the lynching victim was killed after being charged with or suspected of having committed a crime and that such death was inflicted by a mob because of such crime or suspicion of a crime.31
