CLF-NH believes that citizens who are deeply concerned about environmental matters must have the option of resorting to the courts. That's why we're actively opposing Senate Bill 169, which seeks to squelch legal challenges to environmentally questionable state construction projects. Sponsored by Senator Robert Clegg (R-District 14), the bill says that citizens who bring "frivolous" lawsuits that challenge such projects will be liable for increased construction costs incurred as a result of delay. Such costs could range to millions of dollars. Given such tremendous financial risk, citizens and environmental groups would likely be deterred from bringing even the most meritorious lawsuits were the bill to become law.
