2. The attached motion for consolidation of trials is not made for the purpose of delay.

3. The above-captioned claims arise out of a single transaction and involve the same parties. The pleadings set forth have similar allegations and, furthermore, both parties are represented by the same lawyers. It appears, therefore, that a great deal of unnecessary costs and delay would be avoided by all parties, their lawyers, and the court by consolidating these cases into one trial.
