FOREWQRD
The American Bar Association Section of Antitrust Law is proud to
continue its long-standing tradition of scholarship and service for the
practitioner with this Second Edition of Consumer Protection Law
Developments (CPLD). Since its first edition in 2009, the mission of
CPLD has been to synthesize consumer protection law into a coherent
and objective summary of court decisions, enforcement actions, agency
regulations, and guidelines, in an important and evolving area of law.
This second edition covers significant consumer protection developments
since the last hardbound publication, including the addition of a separate
chapter on the Consumer Financial Protection Bureau (CFPB), which
was established with the passage of the Dodd-Frank Wall Street Reform
and Consumer Protection Act of 2010, as well as significant discussions
about the impact of new technologies on consumer protection law, the
expansion in state consumer protection law enforcement, and ever-
growing importance of international legal precedent.
Like many of the Section’s publications, the second edition of CPLD
is the product of the labors of many talented individuals. Special thanks
go to Daniel Savrin and Christine Sommer, who served as the editorial
chairs and oversaw the entire publication effort. They were assisted by an
exceptionally capable editorial board consisted of Christopher Cole,
Aryeh Freidman, Gregory Fortsch, Megan Gray, David Mallen, Sheila
Millar, Gonzalo Mon, Katrina Robson, and Erv Switzer. Also
contributing to this book were the Section’s Officers and Council
members who reviewed and edited the completed manuscript, most
notably Publications Officer Barry Nigro and Consumer Protection
Officer Thomas Zych.
Thanks also go to the dozens of individuals who worked diligently to
gather, analyze and synthesize a huge amount of information, which
greatly enhanced the quality of this book. With apologies in advance to
anyone who may inadvertently have been omitted, the Section would like
