FOREWORD

The Section of Antitrust Law is pleased to publish this second

edition of the Antitrust Discovery Handbook. Like the first edition, this

new edition of the Handbook will be a useful resource for antitrust

litigators. This edition has been updated to reflect the impact on

discovery in antitrust cases of the significant changes made to the

Federal Rules of Civil Procedure in 2001. This edition also greatly

expands the discussion of both the scope of discovery and practical

approaches to gaining discovery in an antitrust case, as well as of the

challenges in obtaining and defending electronic discovery. The Section

is grateful to R. Mark McCareins, who served as the project leader for

this edition, and for the assistance provided to the project by Jagdeep

Bhandari, Mark A. Robertson, and David Steinman, as well as by the

participants in the Section’s February 2000 program on “Discovery In

Antitrust Litigation.” Finally, we are grateful for the hard work of the

support staff and volunteers at Winston and Strawn.
