FOREWORD
The American Bar Association Section of Antitrust Law is pleased to
present this second edition of The Franchise and Dealership Termination
Handbook. Termination of a franchise arrangement raises issues under
not only antitrust law, but also contract law and state and federal
franchise statutes. This book surveys the antitrust and other legal
considerations that govern both the drafting and enforcement of
termination provisions, as well as the remedies available to both sides in
litigation over termination.
The Section of Antitrust Law is grateful to project co-chairs Jason S.
Dubner and Gary W. Kubek, as well as their team of contributing authors
and editors, for undertaking and ably completing this difficult task, under
the leadership of Subrata Bhattacharjee, former Chair of the Distribution
and Franchising Committee of the Section of Antitrust Law. We trust
this book will serve as a guide to those who practice in this important
field.
