FOREWORD

The American Bar Association Antitrust Law Section is proud to

continue its long-standing tradition of scholarship and service for the

practitioner with this new treatise: State Consumer Protecton Law. This

treatise evolved from Consumer Protection Law Developments (CPLD),

which covered both state and federal consumer protection law and was

published in 2009 and 2016, with each edition being followed by

supplements. As the depth of analysis and scholarhip of the CPLD

developed, the Section determined that state consumer protection law

merited its own treatise.

This treatise, like CPLD, seeks to synthesize consumer protection law

into a coherent and objective summary of court decisions, enforcement

actions, and regulations in an important and constantly evolving area of

law. State consumer protection law is a particular challenge to practioners

because there are significant differences in the laws of each state. Indeed,

no two states have identical consumer protection laws. This treatise has a

chapter devoted to each of the fifty states and the District of Columbia,

with nearly every chapter written by an attorney practicing in that state.

Like all of the Section’s publications, this new publication is the

product of the labors of many talented individuals, all of whom are

volunteers. Thanks are due to former Section Chair Brian Henry and

members of the Section Council who recognized that state consumer

protection law merits its own treatise. The Section also thanks the Chairs

of the Section’s Books and Treatises Committee: Leo Caseria and Brandon

Bigelow. They played a critical role launching this publication. The editors

and I are grateful to the Council members who reviewed and edited the

completed manuscript, as well as Publications Officer Darren Tucker. The

outstanding staff of the Antitrust Law Section provided guidance and

technical advice throughout this project, especially Book Publishing

Executive Editor Sarah Craig.

Special thanks go to Erwin Switzer, Alison Eggers, and Kirsten

Ahmad, who served as the editors and oversaw the entire publication
