§15.A. Request to Foreclose Deed of Trust

TO:

The undersigned hereby requests that, in your capacity as trustee [or successor trustee], you commence foreclosure of the deed of trust recorded in Book ____, Page ____, in the Recorder’s Office of __________ County, Missouri. The undersigned hereby represents to you that:

1. The undersigned is the owner and legal holder of the promissory note that is secured by the deed of trust, and the promissory note and deed of trust are hereby delivered to you.
2. Default has been made and still continues in the performance required by the terms of the promissory note and deed of trust.
3. The undersigned has declared the entire unpaid balance of the debt represented by the promissory note to be immediately due and payable and has given notice to this effect to the debtors and all other interested parties. The undersigned has taken all steps required by the terms of the promissory note and deed of trust preparatory to declaring the unpaid balance due and payable.
4. The sum of $__________, plus interest thereon from __________ at the rate of ____% per annum [or in the sum of $__________ per day], plus applicable attorney fees and costs, remain due and unpaid on the promissory note.
5. The name and last known address, as shown on the records of the undersigned, of each of the makers of the promissory note and each of the grantors in the deed of trust are as follows:

9. The undersigned has no knowledge or information indicating that any of the persons referred to in Paragraphs 5 and 6 above have, subsequent to the execution of the promissory note and deed of trust, become members of the armed forces of the United States.

§15.B. Request for Pre-Foreclosure Report

TO:

In preparation for foreclosure of the deed of trust given by __________ to __________, trustee for __________, dated __________, and recorded in Book ____, Page ____, in the Recorder’s Office of __________ County, Missouri, you are requested to furnish the following information, as shown in the public records of that county:

1. Name of each grantee in the last recorded conveyance describing the real estate described in that deed of trust, and the address of grantee[s] as shown in that conveyance
2. A statement of whether any request for notice of foreclosure of the deed of trust has been filed and, if so, the name and address of each person to whom notice is to be sent pursuant to that request
3. A statement of whether any request for notice of foreclosure of any prior unreleased deed of trust on the said real estate has been filed and, if so, the name and address of each person to whom notice is to be sent pursuant to that request
4. A statement of whether there is any unreleased deed of trust describing the said real estate recorded after the recording of the above-mentioned deed of trust and, if so, the name [and address if shown in the public record] of the trustee and mortgagee named in that deed of trust
