Rule 1: Know What to Expect.
• Know where you are going and plan on extra time to find your way to the hearing. [Insert Details regarding location, time, and date of the hearing.]...
• Know that fair hearings are not like a trial. The hearings are in a conference room. The Hearing Officer may not be an attorney and does not wear a robe like a judge. However, the hearing should be conducted with the same decorum and respect as would be expected in a formal court proceeding. The hearing will begin with opening statements from each side. Then DHHS (the Medicaid Agency) will present their witnesses, and those witnesses can be cross examined by a representative of the recipient. The Recipient will then be allowed to present his witnesses. The hearing will end with closing arguments.
