Example of a successful petition for rehearing in the Supreme Court of the United States.—As in the example of the Court of Appeals petition for rehearing just discussed, the document set forth in the next section addresses itself to "the very kernel of the case," and in particular, to the ground on which the original decisions rested, viz., that there was no need, in two cases involving the right to try civilian women by court-martial in time of peace, to consider the scope of the clause which gives Congress the power "To make Rules for the Government and Regulation of the land and naval Forces."¹¹
