Particularly in Family Law Matters

The Wyoming District Courts regularly handle cases involving self-represented (sometimes known as pro se) litigants. A quick survey of district judges around the state reveals that family law matters often involve at least one unrepresented party, which presents challenges to the attorney representing a party and the court.

Many district judges have observed that a steam roll approach by counsel inside or outside of the courtroom to the self-represented litigant is ineffective. The court is interested in learning the facts to best address child custody, visitation, and support. In terms of custody and visitation, the court has a duty to weigh the statutory factors when it comesto determining the best interests of the child(ren). To evaluate each of those factors, the court must look at the evidence closely.

If an attorney uses his legal training to place the self-represented party at an unfair disadvantage, the court's job becomes much more difficult. For example, if an attorney is constantly objecting to a litigants presentation of evidence, the process can become frustrating and a waste of valuable time for all involved.
