Dear Mr. Filmer:

It has come to my attention that you may be planning to film a “Day in the life” video of your injured client. Since the plaintiff would, therefore, be presenting his (or her) case by way of silent testimony,³ we are requesting the right to be present. Such testimony, consisting of visual images, as you know, is no less moving or prejudicial than verbal testimony.

Also, because the Plaintiff is the subject matter of the video, the resulting product should be considered as real evidence and, therefore, open and available to the defendant at the earliest opportunity.
