Prior to June 27, 2018, public sector unions, under the Taylor Law,476 and private sector unions, under the NLRA477 and under the RLA,478 required bargaining unit employees who chose not to join the union to pay a fee in lieu of union dues, usually called an agency fee, for representation. Such fee is usually the amount of union dues, from which, at the request of the agency feepayer, the pro rata share of expenditures for political, ideological and other non-representation-related reasons must be deducted.
