An apparent heir of someone is said to have an "expectancy" in the intestate estate of that person when the latter dies. Expectancies were not assignable under the common law, but they were assignable in equity, and equitable principles govern assignments of expectancies today.90 There is no Washington law on this point, and therefore it is assumed the common law would apply here as well.
