A. GENERAL INSTRUCTIONS
1. Introduction. Insurance on the life of the decedent that is payable to the estate is a probate asset, and insurance on the life of the decedent that is payable to a beneficiary other than the estate is a nonprobate asset. Insurance purchased with community funds is community property, and each spouse/registered domestic partner owns an undivided one-half interest in the policy. Insurance purchased prior to marriage/registered domestic partnership or after marriage/registered domestic partnership with separate funds is separate property. If some of the premiums are paid prior to marriage/registered domestic partnership and some of the premiums are paid after marriage/registered domestic partnership with community funds, the proceeds will be part separate and part community property.
