Chapter 9 Petitions for Original Writs

Rules 84.22, 84.23, 84.24, 91, 94, 97, and 98 govern the procedures on petitions for original writs for civil and criminal actions. Rule 30.31; Rule 84.24(a).

A party seeking an original remedial writ in an appellate court must file:

· a one-page, not counting the caption and identity of the parties and attorneys, writ summary in conformity with Civil Procedure Form No. 16;

· the petition for writ;

· suggestions in support of the petition;

· the $70 docket fee, a statement explaining the specific authority showing a docket fee is not required, or a motion to proceed in forma pauperis; and

· proof of service of the writ summary,
