§9.6 ENFORCEMENT
The HMTA authorizes civil and criminal penalties for failure to transport, package, offer, or accept for transportation a hazardous material in commerce according to the HMTA or its implementing regulations. 49 U.S.C. §§5122-5124. Each act constitutes a violation punishable both by civil penalty and criminal fines. Accordingly, a single shipment could result in multiple fines or penalties, because it is quite common for a load to be temporarily halted at an intermediate destination and then reinitiated.
