§7.3HISTORICAL DEVELOPMENT

CR 7 was adopted with the other Superior Court Civil Rules in 1967. CR 7(b) was amended effective September 1, 1985, to make explicit the applicability of the signature requirement and the sanctions of CR 11, which were amplified by amendment at the same time. See Chapter 11 (Rule 11. Signing and Drafting of Pleadings, Motions, and Legal Memoranda: Sanctions) of this deskbook. CR 7(b)(5) was added by amendment in 1994 in the hope that hearings conducted by telephonic conference call might reduce litigation expenses.

FED. R. CIV. P. 7 was amended in 1948, 1963, 1983, and 2007. The 1948 amendment made clear that if the answer contains a counterclaim, the reply must...
