The Eastern District may give written notice after the appellant’s brief is filed that the case may be submitted for decision without oral argument. E.D. Spec. R. 390. The case will then be submitted on the briefs unless a request for oral argument is filed within ten days after the written notification. Id.

The Southern District requires the appellant to file a request for oral argument in any appeal in which oral argument is desired. S.D. Spec. R. 1(b). The request must be made by a separate pleading titled “Request for Oral Argument” and is due ten days after the date the respondent’s brief was due. Id.
