§ 6.19 • HOMEOWNERS' ASSOCIATION (HOA) INFORMATION AND RESOURCE CENTER

An "HOA Information and Resource Center" was created within the Division of Real Estate.539 The center will be headed by the "HOA information officer," who is to act as a clearing house for information about the basic rights and duties of unit owners, declarants, and associations under the CCIOA.540 The information officer has the authority to request certain records from associations as necessary to carry out his or her duties,541 and is charged with tracking inquiries and complaints and reporting annually to the director of the Division regarding the number and types of inquiries and complaints received.542 Homeowners may submit complaints to the center online or in writing. The Division has instructions at its website on how to file a complaint.543 While the HOA Information and Resource Center and the Division lack investigative or enforcement capabilities and cannot provide legal advice, the HOA information officer will make every effort to contact a complainant regarding his or her complaint if further information or clarification is needed, as well as to discuss the issues in the complaint and assist with possible resources.
