§59.1 INTRODUCTION

This chapter discusses CR 59, which governs motions for new trial, reconsideration, and amendment of judgments. CR 59 resembles CR 60 in that both rules provide avenues of relief for a party aggrieved by an adverse verdict or judgment. Although there is some overlap in the grounds for relief under CR 59 and CR 60 (for example, both provide for relief based upon newly discovered evidence), the rules differ in their general scope and historical derivation. A motion for new trial under CR 59 is based upon the moving party's contention that, for any of a variety of reasons, the court's ruling or the trial was not fair; a motion to vacate a judgment under CR 60 is a collateral attack on the validity of the judgment...
