§57.8STRATEGIC AND PRACTICAL CONSIDERATIONS

The courts, including the trial courts, have some measure of discretion in deciding whether to entertain an action seeking a declaratory judgment or to decline such consideration. This is so notwithstanding the statements in many reported decisions to the effect that the court will not render a declaratory judgment absent the four elements of a justiciable controversy and the two standing elements.
