§53.4.3 HISTORICAL DEVELOPMENT
In 1993, the Washington State Legislature passed the Health Services Act, Chapter 7.70 RCW, for the primary purpose of stabilizing health care costs. One provision of the Act requires mediation of medical malpractice claims and directs the Supreme Court to adopt mediation procedures for such claims. RCW 7.70.100.
The Supreme Court asked the WSBA to develop rules to implement the directive of RCW 7.70.100. A working group consisting of representatives of the plaintiff and defense bars and medical malpractice insurers submitted a proposal in April 1994 that was adopted by the WSBA
Court Rules and Procedures Committee and approved by the Board of Governors. This proposal was adopted by the Supreme Court effective March 11, 1997...
