§5.3 TSCA IMPORT AND EXPORT REQUIREMENTS

TSCA includes specific requirements on companies that import or export chemicals subject to TSCA jurisdiction.

(1) Import certification

Companies that import chemical substances in bulk are subject to the same requirements as companies that manufacture or process the substance in the United States. The term manufacture is defined in TSCA to include importing a substance. 15 U.S.C. § 2602(9).The Treasury Department, in consultation with the EPA, is authorized to adopt regulations governing importation procedures. 15 U.S.C. §2612(b); 19 C.F.R. §§12.118-.127.
