§5.3 HISTORICAL DEVELOPMENT
CR 5 took effect on July 1, 1967, as part of the original Rules for Superior Court, and its provisions have been amended frequently. Significant amendments are discussed below.
CR 5(a) was amended effective July 1, 1972, to conform to FED. R. CIV P. 5(a).
CR 5(b) was amended effective September 1, 1983, to require filing an affidavit of attempted service in lieu of leaving a copy with the court clerk. The amendment also noted that service on an attorney is subject to the restrictions of CR 5(b)(4) and (5), and also of CR 71. The 1983 amendments imposed the requirement for an affidavit documenting an attempt to serve in CR 5(b)(3) and also added provisions to CR 5(b)(4), (5), and (6) terminating the responsibility of counsel once the appeal period has passed or after an appeal is over.
