§44.4COMPARISON WITH FEDERAL RULE

Pursuant to the 2007 amendments to the Federal Rules of Civil Procedure, effective December 1, 2007, stylistic changes were made to Fed. R. Civ. P. 44(a)(1). CR 44(a) remains similar, but not identical, to Fed. R. Civ. P. 44(a). One variation appears in Fed. R. Civ. P. 44(a)(1)(B), which provides that a certificate that an officer, or the officer's deputy, has custody of the record "must be made under seal." CR 44(a)(1) does not expressly require that the certificate be under seal. In addition, CR 44(a)(1) states that a certificate by a judge of a court of record shall be "authenticated by the seal of the court." Fed. R. Civ. P. 44(a)(1) does not make such reference to "authentication by seal of the court." CR 44(a)(1) also provides that a certificate "may be made by any public officer...
