§41.1INTRODUCTION

CR 41 provides the basis for dismissing claims. This chapter covers both voluntary and involuntary dismissals and discusses the following:

(1)the significant differences between CR 41 and FED. R. CIV. P. 41;

(2)the effect of each type of dismissal; (3) the effect of counterclaims, cross claims, or third-party claims on a party's ability to obtain a dismissal; and (4) the obligation of all parties to notify the court of any settlement of the case.
