`§40.3 HISTORICAL DEVELOPMENT
CR 40 was adopted on May 5, 1967, and was effective on July 1, 1967. It was amended effective October 19, 1999, to add text to CR 40(f). CR 40(a)(1), (2), (3), and (4) follow RCW 4.44.020, which was enacted by Laws of 1893, ch. 127, §35 and was derived from REM. REV. STAT. §319. CR40(a)(5) follows and supersedes RCW4.44.030 (repealed 1985), which permitted issues to be brought to trial by either party and was derived from Laws of 1893, ch. 127, §36 and REM. REV. STAT...
