MOTION FOR COURT TO INTERVIEW CHILDREN

PURSUANT TO C.R.S. § 14-10-126(1)

__________, by and through___attorneys, and pursuant to C.R.S. § 14-10-126(1) hereby moves this Court for an order permitting the Court to interview the parties' children in chambers to ascertain the children's wishes as to the allocation of parental responsibilities and in support thereof, states as follows:

1. Certification Pursuant to C.R.C.P. Rule 121, § 1-15(8): (outline efforts to confer with opposing counsel on this motion and whether such efforts were successful)

2. ___children were born of the parties' marriage, (names and dates of birth).

3. A hearing has been scheduled for (date) at (time) to address the following issues:

4. C.R.S. § 14-10-126(1) states, in pertinent part "The court may interview the child in chambers to ascertain the child's wishes as to the allocation of parental responsibilities."

5. (Outline specific reasons why the Court should interview children or other issues pertinent to the children and how an interview with the Court might shed light on those issues. Some examples might be statements by the children about their wishes and whether the parents, child and family investigator or parental evaluator is listening to them; whether a child is threatening some action if he or she is forced into a certain parenting time schedule; whether a child is saying he or she won't go to the other parent's home even if the court orders him or her to do so; or whether the child is expressing vastly different wishes to various people including the parents.)

6. Further, the children have voiced strong feelings and opinions regarding the allocation of parental responsibilities including parenting time in this matter.
