§4.1 INTRODUCTION
A power of attorney is a written instrument by which one person, as principal, appoints another person as his or her "attorney in fact" or agent. Arcweld Mfg. Co. v. Burney, 12 Wn.2d 212, 221, 121 P.2d 350 (1942). Powers of attorney are useful in real estate transactions when the principal is not readily available to execute documents. "Durable" powers of attorney may be used to effect the principal's intentions (i.e., even if the principal is disabled or incompetent).
