§ 4.31 • SPECIAL DISTRICTS

§ 4.31.1—Special Districts

Special districts have the power to acquire, dispose of, and encumber real and personal property including, without limitation, rights and interests in property, leases, and easements necessary to the function or the operation of the special district.502

Fire protection districts have, in addition, the power to acquire, dispose of, or encumber fire stations and any interest therein, including leases and easements.503

Park and recreation districts may use the power granted to special districts generally for the establishment of recreational facilities, including leases, easements, and other interests in land for the preservation or conservation of sites, scenes, open space, and vistas of recreational, scientific, historical, aesthetic, or other public interest. "Interests in land" means any rights and interests in land less than the full fee interest, including but not limited to future interests, easements, covenants, and contractual rights. Every such interest in land, when recorded, is deemed to run with the land to which it pertains for the benefit of the park and recreational district.504

A metropolitan recreation district may acquire, own, and operate public recreation facilities, open space and parklands, playgrounds, and television relay and translator facilities; may acquire and maintain land, buildings, or other recreational facilities; and may sell and exchange public recreation facilities, open space and parklands, playgrounds, and television relay and translator facilities.505

Sanitation, water and sanitation, and water districts have the power to acquire water rights.506

A metropolitan water district has the power to purchase, trade, exchange, acquire, buy, sell, and otherwise dispose of and encumber real and personal property, water, water works and plants, and any interest therein, including leases and easements.507

A metropolitan sewage disposal district has the power to purchase, trade, exchange, lease, buy, sell, encumber, and otherwise acquire and dispose of real and personal property and interests therein, including water and water rights.508

A cemetery district has the power to acquire, hold, and convey real and personal property for cemetery purposes within the district, and to receive, acquire, and hold donations or bequests of real or personal property.509
