§ 4.1 • INTRODUCTORY

Any person, association of persons, or body politic or corporate that is entitled to hold real estate, or any interest in real estate whatever, is authorized to convey the same to another or to a body corporate or politic by deed.1 The term "person" means:


[A]ny individual, corporation, government or governmental subdivision or agency, business trust, estate, trust, limited liability company, partnership, association, or other legal entity.2

Nevertheless, with certain exceptions,3 a person is prohibited by statute from knowingly taking or placing title to taxable property in the name of another or entering into a contract to purchase or sell taxable property, or assisting any person in doing so, for the purpose of attempting to qualify such person as an eligible elector at any special district election.4 The only penalty for violation of this prohibition is that any ballot cast in violation of the prohibition is void, as determined in an election contest;5 apparently the transfer itself remains valid.
