§ 32.2 • ELEMENTS

To recover in an action for premises liability under the statute, the plaintiff must show that:

1) The defendant was a "landowner" as defined in C.R.S. § 13-21-115(1);
2) The defendant owed the plaintiff a duty of care;
3) The defendant breached the duty of care; and
4) The plaintiff incurred damages caused by the breach.¹⁷
