§ 29.4 • REMOVAL OF IMPROVEMENTS FROM ENCUMBERED PROPERTY

If a lien is recorded prior to October 1, 1990, an owner of real property may not remove improvements from the real property (unless the improvements are expressly excepted from the lien) without first obtaining the written consent of the holder of the lien. With regard to indebtedness secured by deeds of trust or mortgages recorded on and after October 1, 1990, the owner must obtain the written consent only of the holder of the most senior lien that encumbers the property.20 Such removal is a class 2 misdemeanor.21
