§ 29.3 • ELEMENTS

A claim for negligent hiring has five elements:

1) An employment or agency relationship must exist between the employer and the person who injured the plaintiff;
2) The defendant employer owed a duty of care to the plaintiff in the selection of the defendant's employees;
3) The employer breached its duty of care;
4) The plaintiff suffered an injury; and
5) The defendant's breach caused the plaintiff's injury.²⁷
