27-1 Removal Generally

As a general rule, any case filed in state court over which the federal district courts would have had original jurisdiction may be removed to federal court.1 In other words, a case may be removed to federal court if it could have been filed originally in federal court. Put yet another way, subject to exceptions, any case over which the federal district court has subject matter jurisdiction is removable to federal court if first filed in state court.
