§ 25.1 • THE CAUSE OF ACTION

"The tort of malicious prosecution has traditionally been disfavored in the law because of its chilling effect on the right of access to the courts."1 "The malicious prosecution tort addresses the situation where a person knowingly initiates baseless litigation."2 The claim can arise from either a prior criminal or a prior civil case.
