Property division provisions cannot be revoked or modified unless there is a finding that conditions exist that justify the reopening of a judgment. C.R.S. § 14-10-122(1)(a). C.R.C.P. 60 provides the conditions under which it is justifiable to reopen an agreement or judgment. In re Marriage of Scheurman, 591 P.2d 1044 (Colo. App. 1979). For disclosures made after January 1, 2005, C.R.C.P. 16.2(e)(10) extends the period during which the court retains jurisdiction to allocate material assets and liabilities to five years when there has been an omission or non-disclosure that materially affects the division of assets and liabilities.
