§ 22.6 • DEFENSE OF CONTRACT CLAIMS

If the elder victim has entered a contract with the defendant as part of the abuse, then the elder has several defenses, such as fraud, undue influence, and duress.⁹¹ The plaintiff may accordingly request rescission of the contract based on these defenses.
