2.11 UNINSURED MOTORIST CLAIMS

In these types of claims, there may arise an issue of whether or not the carrier can take a recorded statement of the plaintiff. Virginia Code section 38.2-2206(H) provides that nothing may be required of the insured other than the establishment of legal liability. As such, the statement cannot be compelled.¹⁷⁶
