§ 2.23 • ANSWERS "ON INFORMATION AND BELIEF"

Standing alone, answers based on "information and belief" are unacceptable. Almost inevitably, that phrase is used when trying to avoid a lack of facts. The courts addressing the issue have held that when information and belief is relied upon, the answer must specify the information.
